BRAN, Komnas HAM explore cooperation to resolve agrarian conflicts

Komnas HAM had received around 2,700 complaints concerning agrarian conflicts over the past three years.

Jakarta (ANTARA) – Indonesia’s National Agrarian Reform Agency (BRAN) is exploring a memorandum of understanding (MoU) with the National Commission on Human Rights (Komnas HAM) to accelerate the resolution of agrarian conflicts while prioritizing human rights protection.

The initiative was discussed at a meeting between BRAN Head Dedi Prasetyo and Komnas HAM Chair Anis Hidayah at the commission’s office on Friday.

Prasetyo said closer cooperation with Komnas HAM was an initial step toward establishing a more coordinated mechanism for resolving agrarian conflicts while ensuring legal certainty and protecting people’s rights.

“We will continue to strengthen cooperation between BRAN and Komnas HAM to resolve agrarian conflicts. As a first step, we will focus on establishing an MoU to improve coordination and cooperation in handling these disputes,” Prasetyo said.

During the meeting, Prasetyo received a briefing and data from Komnas HAM on agrarian conflicts across Indonesia.

Some disputes have persisted for years, leaving affected communities struggling to secure resolution and access to justice.

According to Prasetyo, resolving agrarian conflicts requires collaboration among government institutions, data harmonization, and comprehensive mapping of the issues.

Each case must be examined based on field findings, legal considerations, land ownership and tenure history, and the social conditions of the parties involved.

This approach, he said, would help authorities address the root causes of disputes while ensuring that each institution acts within its mandate.

Hidayah said Komnas HAM had received around 2,700 complaints concerning agrarian conflicts over the past three years.

The complaints involved various parties, including corporations, and disputes related to state assets.

The figure underscores the need for more focused coordination in addressing agrarian conflicts.

She added that the commission had spent about two years developing a human rights-based roadmap for resolving such disputes.

The document includes recommendations on institutional reform, governance improvements, regulatory changes, and preventive measures to reduce the recurrence of agrarian conflicts.

“We will also seek institutional cooperation between Komnas HAM and BRAN in handling agrarian conflicts so that these efforts are grounded in a human rights-based approach,” Hidayah said.
